Twelve years in prison have been demanded against two people from Zwolle on appeal for involvement in a fatal shooting at a carpool site near Vaassen. At that spot, 24-year-old Samet lost his life after a coke deal got completely out of hand. According to the prosecution, at least four people shot that night in March 2017, including a friend of the victim.
The demands against the Zwolle men are the same as the sentences previously imposed by court. Despite extensive investigation, it remains unclear whether the Zwollenaren, or co-accused, fired the fatal shot. From wound and trace evidence it cannot be determined with which weapon the fatal bullet was fired. In addition to the two Zwolle men, a friend of theirs from Leeuwarden also wielded a firearm, the prosecutor says. The Friesian has also been demanded 12 years in prison.
Uzi
A second Leeuwarder was there that night and, according to the prosecution, must also have known about the plans surrounding the coke trade, but there is no proof that he fired. Even though co-defendants say he held an Uzi pistol machine gun. Justice wants him behind bars for five years. That's higher than the court imposed on him, 14 months for gun possession.
No severe weather
The victim's boyfriend was also sentenced to five years in prison for shooting at random in the carpool parking lot. "He thereby accepted the risk of killing another person," the prosecutor said. No punishment was imposed on him by the court because he allegedly acted in self-defense. A threatening situation had arisen, according to the court, when the other suspects tried to rob him and his mate of a batch of drugs.
100 packs
According to the Justice Department, it is established that two Zwolle residents went to the carpool place together with two Leewarders to steal 100 grams of coke. This is evident from app conversations prior to the fatal evening. For example, messages were sent, such as: "I know a Turk from whom we can easily take 100". In addition, they took a bag full of weapons and "thus anticipated violence."
Afterwards, according to the prosecution, they tried to cover their tracks. For example, the victim's phones were taken and dumped. Also, one of the Zwolle suspects allegedly took casings from the crime scene to make police investigations more difficult. Once back in Zwolle, the suspects allegedly checked their car, an Opel Vectra, for any bullet hits.
Shot in car
Victim Samet had come to the carpool site with a buddy. They had 100 grams of coke with them. When a Zwolle man and Leeuwarder got into the car with them, an argument ensued. The first shot was fired by the Leeuwarder. After that, everyone fled the car. The victim's mate fired at the others while fleeing. Possibly he hit his own friend Samet in the process.
Underworld War Zwolle
The two Zwolle men and one Leeuwarden man also fired, the prosecution says, toward Samet and his mate. The latter was hit in his hand. It became silent, after a scream of pain was heard. Samet fell down. Everyone left him for dead.
One of the Zwolle men has also come into police view as an arms dealer in the Zwolle underworld war. For example, he allegedly talked to one of the main suspects about the purchase of weapons. The other Zwolle man, according to the prosecution, went wrong again on drug trafficking during a suspension of his remand. Both Hanseatic men were warned by police that relatives of the fatal victim may have targeted their lives in retaliation.
The Zwolle men both deny they shot that fatal night. They also say they did not intend to steal the drugs. One of the Zwolle men regularly did "business" with the victim, "so why suddenly rob him now?"
The court will rule in a few weeks.
